SPEAKER: David Barkey, ADL’s Senior & Southeastern Area Counsel
TOPIC: “Hate Crimes – Elements, Impact & Offenders”
David Barkey serves as ADL’s Senior & Southeastern Area Counsel. In that position, he provides legal, legislative and public affairs counsel to three regional offices within eight southeastern states on issues including, hate crimes, extremism, discrimination, free speech, and religious freedom. Mr. Barkey regularly works with and trains federal, state and local law enforcement on legal and non-legal aspects of hate crimes.
Mr. Barkey previously served as ADL’s Associate Director of Legal Affairs based out of its national office in New York City. He joined ADL in 2001 as its Midwest Area Counsel based in Chicago, IL. He is admitted to practice law in Florida, Connecticut, and New York.
Course Description:
All Americans have a stake in effective response to violent bigotry. These crimes demand priority attention because of their special impact. Hate crimes intimidate the victim and members of the victim’s community, leaving them feeling isolated, vulnerable, and unprotected by the law. Failure to address this unique type of crime could cause an isolated incident to explode into widespread community tension.
Topics covered in this two-hour interactive continuing legal education course include, overview of hate crimes laws, Florida’s hate crimes law, the federal Hate Crimes Prevention Act, constitutionality of federal and state hate crimes laws, case studies, hate crimes statistics, key features of hate crimes, hate crimes indicators, and offender typology. Participants will receive two hours of general CLE credits for attending the course.

Leading the efforts to deter and counter hate-motivated crimes, ADL drafted model hate crime legislation in 1981, covering all hate crimes. Forty-five states, including Florida, have since enacted laws based on or similar to the model, which was unanimously deemed constitutional by the U.S. Supreme Court in 1993.
The 2009 passage of the Matthew Shepard and James Byrd, Jr. Hate Crime Prevention Act-the most important, comprehensive and inclusive federal hate crime law- is a direct result of ADL’s leadership in this area.
ADL’s Florida Office currently leads the 200+ member Florida Hate Crime Coalition, which has a mission to secure amendments to Florida’s hate crime laws that would make them comprehensive.
